Terms of Service

These Terms of Service (these “Terms”) set out the conditions for using Hackoh (the “App”). By using the App, users agree to these Terms.

1. Accounts

• Users are responsible for registering with accurate information and appropriately managing their authentication credentials.
• Unauthorized sharing of a single account and impersonation are prohibited.

2. Handling of Posted and Created Data

With respect to data that users create or enter within the App (brewing records, aging records, photos, feedback, content from “Ask Hakkoh-chan,” etc.; collectively, “Posted Data”), users agree to the following.

• Users agree that we may use Posted Data to provide, improve, and develop the App, and to conduct statistical analysis and research related to fermentation (details of this handling are governed by the Privacy Policy).
• When we use Posted Data, we will, in principle, process it into a form that cannot identify individuals (statistics or anonymization). We will only publish it externally in a form that could identify an individual if we have obtained that individual’s prior, specific consent.
• Users shall not post content that infringes the rights of third parties or that violates laws or public order and morals.

3. Prohibited Conduct

The following are prohibited: conduct that violates laws or public order and morals; infringement of third-party rights; unauthorized access to other users’ data; reverse engineering; and placing an excessive load on the App, among other similar conduct.

4. Purchasing Ingredients and Payment

• Purchases of ingredients through the App are made via Stripe payment processing and through us (including our official website).
• Prices, stock availability, shipping, and other conditions are as displayed during the purchase process. Returns and exchanges are subject to separately specified conditions.

5. Handling of Data

• The handling of user data is governed by the Privacy Policy.
• Users may delete their account at any time (Settings → Delete Account).

6. Intellectual Property

Rights relating to the App and its components (including its design, logos, characters, software, and any published methods or content) belong to us or to their rightful owners.

7. Disclaimer (Regarding Fermentation and Food Safety)

• The App is provided “as is.” To the extent permitted by law, we do not warrant the accuracy or availability of its data.
• The fermentation predictions, brewing guides, and information about flavor and readiness that the App provides are general guidelines only, and do not guarantee the safety or quality of any food you actually produce. Fermentation involves living organisms, and results vary depending on environment and ingredients.
• Judging whether mold, spoilage, or any other abnormality is present, and whether something is safe to eat, is the user’s own responsibility. To the extent permitted by law, we are not liable for any health effects or similar harm.

8. Changes to or Termination of the Service

We may change the content of the App or discontinue it after providing prior notice.

9. Changes to These Terms

We may revise these Terms as needed, and we will notify users of important changes within the App or through similar means.

10. Governing Law and Jurisdiction

These Terms are governed by the laws of Japan. Any disputes shall be subject to the exclusive agreed jurisdiction of the district court having jurisdiction over the location of our business, as the court of first instance.
